SCHOOL BOARD LEGAL STATUS

 

 

Article VI, Section 44 and Article VIII, Section 9 of the 1974 Constitution of Louisiana defines a School Board as being a political subdivision of the State.  Article VIII, Section 9 of the 1974 Constitution provides that the Legislature shall create Parish School Boards and provide for the election of their members.

 

Article VIII, Section 10 recognizes the Parish and City School Board systems in existence on the effective date of that constitution and provides that they are subject to the control and supervision of the Louisiana Board of Elementary and Secondary Education (BESE) and the power of the Legislature to enact laws affecting them.

 

Article VIII, Section 10 and La. Rev. Stat. Ann. §17:51 establish School Boards as public bodies corporate with the power to sue and be sued.  Bank of Winnfield v. Brumfield, 1929, 11 La. App. 647, 124, So. 628. Hawthorne v. Jackson Parish School Board,1927, 5 La. App. 508.

 

The Beauregard Parish School Board is the governing authority for the Beauregard Parish School system, and as such, is a legislative body with the power and authority set forth in La. Rev. Stat. Ann. §17:81 and other statutes of the State of Louisiana and Rules and Regulations adopted by the Louisiana Board of Elementary and Secondary Education.  In addition, the School Board possesses such implied powers as are reasonably necessary or desirable to carry out its duties, functions and responsibilities provided that such regulations or policies as it may adopt pursuant to such powers do not conflict with the laws of the State of Louisiana or Rules and Regulations of the Louisiana Board of Elementary and Secondary Education (BESE).
